Re: Minn. Cops Confiscate and Sell Drunk Drivers' Hot Rod
"serves as a warning to others..." that there is no such thing as forgiveness, or fairness in law. I like their justification "5 DUIs since 1983"36 years, without any idea whether or not those 4 prior DUIs were last year or in 1984... I'd be willing to bet that there isn't a person alive who drinks alcohol, or has driven while sleepy, or has been on a prescription med who hasn't driven 5 times illegally.... and the net effect of this is that the cops prove their is no fairness in law as the "fine" or "punishment" for the crime is a sliding scale.
However, they're right, don't drink and drive.... don't drive and use your cell phone.... don't drive and listen to the radio..... and for heavens sake, don't drive and enjoy the view around you..... because if you do they'll take your car away, next your house, and if you have kids - them too (not sure the last one is a punishment) :D.Doing it all wrong since 1966

Good. Glad the car is going to someone who won't drive drunk and that the police department gets something good out of it (and the courts get some of the money back they wasted on this guy).
If they'd taken it after one offense I'd cry foul, but five offenses makes it pretty clear this guy makes a habit of it. If they *caught* him doing it five time, how often did he do it and didn't get caught.
If this guy can't, over the course of 27 years, learn that driving drunk is a *bad* thing this is unlikely to change things, but maybe the empty spot in the driveway will serve as a reminder.

I'm afraid I don't believe in confiscation of property as a punishment. Jail time and fines, going by a set standard...yes. In spite of anything ever said otherwise, confiscation by it's nature rewards selective enforcement. The money they got by nailing this guy paid for some nice stuff although no mention was made of any damage he caused, this time or the others. Since his car is apparently in good shape we'll imagine there was none.
Highway deaths of innocent people around here, the reason we say we do not tolerate drunk driving, do not result from tipsy old guys driving their pride-and-joy hotrods home from the bar. They result from people with no money, no sense of responsibility, often no licenses, and the basic lack-of-sense about life that keeps them at the bottom financial-wise. Cell-phone yakkers, guys playing with their radios while speeding around corners, and yes, habitual drunks driving perhaps the company truck. Genuinely dangerous people but not-so-lucrative to keep an eye on...
You can wreck a guy enough with imprisonment and fines, and do it fairly. Confiscation of property is just corruption waiting to happen....

Re: Minn. Cops Confiscate and Sell Drunk Drivers' Hot Rod
I agree that he does not deserve to drive and he should lose his license. I wonder how many other minnesotans have been fined $19,500.00 for Drunken driving?? This is real bad business. What's to stop a minnesota cop from lying about
someone's intoxication level because they just don't like the person or the person beat them on a speeding charge??? Don't think that it doesn't happen. I would bet this poor bastard has paid big fines for all the previous tickets also.
His car shouldn't have been confiscated, he should have gone to jail for at least 2-3 years! Applauding cops because they found ways to screw people even worse will only embolden them to do worse. I really don't see them confiscating cars that are crap and only worth a couple of hundred dollars.Racing is living, anything before or after is just waiting!!!

It's one thing to confiscate the ride if it is a drug dealer. Drug money probably bought it. A drunk driver should be jailed and forced to attend alacohol assesment sessions and AA meetings, but taking his ride is overstepping the bounds.Hauling ass & sucking gas are the best uses for a truck.

I don't know man. You'd think after getting popped the first, I don't know, 3 or 4 times, he'd just stay home and drink a beer. Some people never learn until they get the stake driven through their heart or they kill someone.I R Bob
You can't drink all day unless you start in the morning!
