This is what you get when you decide you want no government interference or restrictions on your "rights". Those who wave the banner for personal liberty and for no government restrictions are happy and smiling until something like this comes up and then, all of a sudden, government restrictions are welcome.

The petition asks selectmen to "immediately enact on an interim basis a race track ordinance," which would give residents some time to become informed on it and decide on it at next year's town meeting.
In other words, they need time to organize more resistance against it.

One guy on the papers forum seems to know the law pretty well. If so the race track should be a go.
Several years ago the state of New Hampshire created an RSA that states that no municipality can create "reactionary "zoning. The intent was that a developer planned out a development that fit all the current zoning and planning regulations and all of a sudden the locals don't like it. They hold a town meeting and try to create a new set of rules to block this development. Now the same thing applies for a town that has no rules or regulations. In this case the individual has created a set of plans but there is no group , zoning or planning boards , to present it to outside of the selectman. Because there is no current rules against a drag strip , since there is no rules at all , then the town can't have a meeting and come up with a set of rules to block this plan because that would be "Reactionary Zoning".
Here is what the town will have to do just to create the rules to prevent this from happening again but if there are no rules and the town tries to create just one set of rules that attempts to block only this business then they will lose the case in court right away.

Deja-vu all over again. Several years ago, there was a group (unfunded and charlatans, but that's another story) that was going to build a track here. It would have been on some rather rough land east of the airport. AIRPORT is a key word here. The richy-rich-bitch set that lived ACROSS A HIGHWAY on the WEST SIDE OF THE AIRPORT (re-planes coming and going, cars all day and night on the 4 lane) complained like hell. "Noise problem" complaints from people that lived over ONE MILE AWAY, where the sound from the track would have to travel across a 2 LANE HIGHWAY, AN AIRPORT AND A FOUR LANE HIGHWAY to get to the east edge of the housing area. OH - and there is also a big timeCOUNTY FOOTBALL STADIUM AND RODEO ARENA right on the north edge of their housing area. Guess what happened to that track proposal.
Our track is here now and where it is because the guy that built it put it on land zoned heavy industrial, a long way from the dainty napkin group and he had mucho connections in the city. Otherwise, maybe not.
