    calling stoneshrink

i need some legal advice and IIRC youre a lawyer

alright, so i bought a 1996 honda civic from my buddy jeffrey hutchinson about a week ago for $400. i was going to put a vtec head on it but after finding out how much it was going to be i decided to just put that money into the mustang and resell it, so i put it on craigslist yesterday.

today i get a call from some guy asking if i want to trade it for a 1982 silverado with no motor, when i said no he puts his gf/wife/whatever on the phone and she starts telling me that a year ago when they sold the car she got stiffed out of $800 and she tells me if i dont trade the civic for the truck that she'll have the police come take the car away. she said she had "proof" that she got ripped off $800. her "proof" of it is a bill of sale that says it was sold for $2500 and 2 "witnesses" (probably just friends of hers lying for her)

she has no proof that the guy who bought the car off her (not my friend) DIDNT pay the $2500, so i should be able to just tell her to get lost, right? to me it seems like shes just trying to force/scare me into trading for the truck

If the DMV doesn't show a lean on the title, and you weren't the guy she sold it too, then you are clear. She's still owed by the other guy if true.
        Escaped on a technicality.

Absolutely nothing, in order to have something notarized you and all people involved have to sign the document in front of a notary public >> http://en.wikipedia.org/wiki/Notary_public

so getting the bill of sale notarized wouldnt do anything for me?

as long as the bill of sale they made up when they sold the car to the other guy is signed by them they shouldnt be able to do anything right?

Debts ony follow objects when there is a lien against it. Otherwise they stick with the people.

True that Randall. I would not worry about it at all.

so even if they have the title (which i dont think they do), as long as there isnt a lien on it i keep the car?

I don't know the wacky laws in Maine about not needing a title, but if the debt isn't registered with the department of motor vehicles against the vehicle then it's still with the guy. If you haven't put the car in your name, then it's still the last guy's car too. I know in CA and NV you want to get to DMV asap to get the paperwork filed when both getting and selling a car.
