I realize I wasn't clear - she's was released Friday night with a mild concussion, and she's made it through the 24 hour observation period.

we have a lot of undocumented people in jail here, and guess who pays for them to eat and sleep. It's pretty easy to get cynical about it.
I hadn't thought about contingency.. was just thinking freebie slap. I don't know what was said exactly, but if it was anywhere close to what I think I heard, I'd want someody to get the point rammed down their throat - the response from your Protectors was not acceptable. Stupid should hurt so you'll remember next time? If it's coming from above and he wasn't just being a jackass, yeah, I'd want to go up the chain to the point of origin. Good grief, even if it was from above, can you see yourself EVER telling a parent that? Particularly one of an injured child... yikes.
Twelve people on the bench with children. I think we know how that would turn out.

the cynic in me thinks this: the cop was being pragmatic. He knows the driver will never show up in Court, so why write so many tickets to someone who'll never show? - OTH if he writes up the parents, he can go arrest them and get even more money out of them if they don't show.
pro bono is for cases that will never pay the attorney's fees but are a just cause (I generally have at least one of those cases going at any given time). This case is a contingency case where the governments pays my fees because of their stupid policies (hard to get re-elected when your opponent uses these cases to point out the inept policymaker). I still don't think it was the cop's call about not arresting; at minimum it was his supervisor and most likely department policy... what rubs is if it'd been a citizen, they'd have cuffed and stuffed him before the motor was cool in his truck.

Really? .... No citation for the driver? .... I'd have jailed him!
Where's the culpability on the part of the child? I can see if it was pitch dark out on a non lighted rural road and the kid was dressed in all black .... Her parents need to file a formal complaint with the PD as well as the DA's office. In Colorado (and most states are similar) citizens are able to "swear out" a complaint with the DA's office and by-pass the PD/SO.
Glad the kid is doing ok .... thoughts and prayers sent non the less.

Mild concussion is a blessing. I hope that she recovers quick.
Pedestrians have the right of way in Texas, or more specifically, since only emergency vehicles actually "Have" the right of way, you must yield the right of way to a pedestrian.
Go light them up. That's the stupidest comment I've heard from a cop in quite a while. Somebody's badge needs to stop working. That just sounds like an invitation for a Pro Bono Boning.Last edited by Beagle; August 20, 2011, 06:57 AM.

It cracks me up how some parents use signs that are mentioned for the end of their drive"watch for kids "or "kids playing "and put them in the street of there subdivision.I'm thinking really? I'm going to drive over one of those signs one of these days. Now back to the subject......no matterif the child was at fault .......they had a driver that had broken several laws.....throw the book at him!

Glad the little girl is going to be o.k.. They need to take that unlicens, non insured immigrant and and use him as an example. How he is NOT getting a ticket is mind blowing....

What the hell??? How could they not cite the driver? If he was operating a vehicle without a license HE SHOULD GET A TICKET NO MATTER WHAT! Not to mention everything else! Was it time for shift change at the cop shop or what?
