I'm pretty sure they can own the domain without owning the rights to market under that name. Considering no one was likely paying maintenance costs to the domain provider it shouldn't be surprising.

TC...the site was dead. DF and Chad didn't own the domain name. The company they were working for did. They let it lapse because it was worthless and someone else bought it.
