While an ambulance was on-site with a crew capable of dousing fires, the vehicle wouldn't start when Cruz crashed, forcing Cruz's son, the Atco owner and other Atco staffers to run to Cruz to help put out the flames, according to the lawsuit.
She will get some compensation but insurance will not pay that much so she will either have to settle for their limit or force them to close the track.

Joe Sway Sr., Atco's owner, denied the lawsuit claims.
"The ambulance was on scene; it has to be when we're racing. The ambulance was functional. And we have a fire-suppression system on a pickup truck, which was operational and did respond," Sway said.
Besides, "the driver was out of the car by the time the first responder got to him," Sway added.
Sounds like he kind of blows their allegations out of the water.Baseball, hot dogs, apple pie and Chevrolet!!!

Bringing a lawsuit is a common practice when someone is injured or dies as the result of a racing related injury.
In many cases it is not only the track that is suited it is a any sanctioning body that has it's name associated with the track such as the N.H.R.A. or Nacar
Many times they will file a lawsuit against every company that has their decals / stickers on the race car or even a sponsors name on the side. And don't forget about the engine builder or the chassis shop that either build the frame or the roll cage.
The theory is that will look to collect damages from everyone one they can.
If they can prove that any of these could have contributed to the accident is some way leads to a damage award.
This is one reason in order to sell any products with the N.H.R.A. logo on them you must carry a one million dollar liability policy just to protect the N.H.R.A. or your own company from lawsuits.
Bottom line is whatever happens next is going to cost money to defend yourself and you can bet there are lawyers waiting to take the case.

Admitting, I never drove on a drag stip.. Done plenty burnouts.. Some street racing. In the derby arena, spinning around in a muddy track.... Aren't we wired to lift when shit gets stepped on? .. Seems I read Squirrel lifting, not to break his ride home at Hamb.. Smart thing to do!
