A Canadian street racing law that deemed anyone driving 50 kph above the posted speed limit as “street racing” has been deemed unconstitutional by an Ontario judge. The ruling came on the case of a 60-year-old woman who sped up to pass a truck and was subject to the harsh punishment of the draconian law.
The “catch” that the judge had a problem with was the part of the law that would have allowed those found to be guilty of violating it to serve a prison term of up to six months. Where the law falls down is the area of one being able to defend themselves (in a legal sense) against a prison term. If you’re speeding, you’re speeding, for whatever reason you are breaking the rules and by the book would be subject to time in the klink.
