Evan Knoll’s first big day in court was once again postponed by a judge for multiple factors, one of which seems to indicate that the Feds will be bringing more or different charges against the former racing gasoline company owner. There was an expert witness that was unable to attend on the original date and Knoll’s new lawyer claimed that he needed more time to prepare as he had only been on the case for a week prior to the meeting.
One of the more interesting lines in the story came from Assistant US Attorney Michael McDonald when he told the judge that a, “superseding indictment” is “forthcoming”. Some quick phone calls and e-mails over the definition of a “superseding indictment” garnered us the knowledge that the government may have unearthed additional evidence of wrongdoing by Knoll and will add charges to the already heavy list they have. One lawyer friend gave us the example of someone charged with attempted murder where the person is indicted while the victim is still alive, but then the victim dies of injuries inflicted during the murder attempt and the charges are changed to a full blown murder rap. To this point, Knoll has been charged with bank fraud and making false claims in conjunction with a tax fruad scheme.
The government claims that Knoll took more than $80-million dollars in excise tax refunds on racing fuel he never actually made.
Knoll is now scheduled to be in court on December 7,2011. That’s a date that lives in infamy forever in American history and may begin a period of infamy for the sport of professional drag racing when the depth and breadth of Knoll’s alleged wrong doings begin to surface.
