Finally, An Update in the Jeremy Mayfield Case

Finally! We’ve been waiting for months to hear some new stuff about the Jeremy Mayfield case against NASCAR. The actual trial is not set to begin until September, but the pre-trial wrangling is well under way. The most resent dust-up has to do with where Brian France lives. What the hell does that have to do with anything you ask? Read on.

France’s place of residence will ultimately determine where the trial is held. Since he owns property in both Daytona, Florida, and Charlotte, North Carolina, and seems to spend nearly equal time at each place, it is up to a judge to determine where home is for France.

NASCAR’s attornies are fighting for Florida to be recognized as home and Mayfield’s attorney Mark Geragos is claiming that North Carolina should be recognized as France’s place of residence.

If the judge rules that France lives in North Carolina, the trial will be held there in state court. If he rules Florida, the trial will be held in federal court. Of course, the federal court trial, located in a more remote location, would be far more costly than a trial in Mayfield’s local state court in North Carolina. Also there are procedural processes like jury selection that could better serve Mayfield in state court and help NASCAR in federal court.

We’re still saying that the actual trial will never happen and NASCAR will do its damndest to bleed Mayfield dry before opening arguments are made.
