The case is Fenner et al v General Motors LLC et al, U.S. District Court, Eastern District of Michigan, No. 17-11661, and the short and sweet version of what it’s all about is almost like deja vu at this point: One Mr. Andrei Fenner of Mountain View, California and one Mr. Joshua Herman of Sulphur, Louisiana, backed by Hagens Berman Sobol Shapiro (the law group that was instrumental in the Volkswagen “Dieselgate” deal and has been on GM over diesel-equipped Chevrolet Cruze vehicles as well) and Hilliard Munoz Gonzalez (which handled GM ignition switch lawsuits) are suing General Motors and Bosch over the emissions output of Duramax diesel V8s in the 2011-16 Chevrolet Silverado and GMC Sierra pickup truck lines.
Both Fenner and Herman claim that on-road testing of their 2011 GMC Sierra and 2016 Chevrolet Silverado (respectively) showed higher-than-allowable levels of nitrogen oxide, with the upper level somewhere five times higher than allowable under current Clean Air Act regulations, and of course, both men claim that they wouldn’t have purchased the vehicles if they had known that there was some kind of “cheat” hidden in the software that they claim is behind it all.
Like FCA US, who is dealing with their own lawsuit over diesel emissions, GM is denying wrongdoing, with Pat Morrissey, GM Corporate Communications liasion, issuing the following statement: “These claims are baseless and we will vigorously defend ourselves. The Duramax Diesel Chevrolet Silverado and GMC Sierra comply with all U.S. EPA and CARB emissions regulations.”
Unlike FCA, who has somewhere under 110,000 vehicles involved, GM has a combined figure of 705,000 vehicles, which could equate into monstrous penalties (think tens of billions of dollars as an early estimate.)
So these two clowns claim they would not have bought a diesel pickup if they new the emissions were high? Do they check every vehicle they buy? And if they are so concerned, why not check them before buying? Sounds like a couple of idiots looking for a payday.

Bad news buddy, this is affecting nearly EVERY diesel vehicle on the road. I\’ve gone through six trucks in four years, from similar issues. When you depend on the capabilities of these vehicles to provide for your family, you can\’t afford to wait 48 days as I did for dealers to tinker and hypothesize what\’s wrong; for the nay-sayers that claim diesels are overrated, when somebody makes a gas truck that will safely tow 17,000 pounds then gas engines will be a viable alternative. More than likely, these guys are trying to recoup money and work lost, because of these trucks and I hope they do because I\’ve easily lost over $250k between downtime and repairs for these half-ass designed emissions systems.

Sorry to politicize things, guys, but these lawsuits are the direct producct of hard core leftist factions within the EPA. In spite of the Trump admin’s efforts to reign in the weaponized agency, there will be more of this to come. The suit is funded by a group that has received funding from the EPA. The basic aim of these people is to undermine commerce and industry by any means necessary.
Expect this activity to expand unlees your new Prez really takes a broom to the EPA.
