It looks like the defense has blinked first. Jeremy Mayfield who recently was courting top celebrity attorny Mark Geragos as potential legal representation, has apparently retreated from his intention of getting an injunction against his suspension from NASCAR, The Sporting News reports.

The court filing made by Mayfield’s new attorney, Dan Marino (seriously, that’s his name) and according to the analysis in The Sporting News story, seems to indicate that they realize that their efforts at an injunction would be fruitless. The case would be handled by a judge who has made it clear through other decisions that he would favor NASCAR’s side if Mayfield tried to fight them on the ban.

This sucks for us as we were getting excited for the December court fireworks. Oh well, looks like we’re still on for the September 2010 trial. We’re hoping that Dan Marino sees fit to keep the media informed of their every development on the case.
