Gentleman Start Your Attorneys; December 1 Hearing for Mayfield NASCAR Injunction

Wednesday it was announced that Jeremy Mayfield’s appeal to the injunction NASCAR has placed on him will be heard in court on December 1, 2009. This legal clash, depending on the outcome, will allow Mayfield to drive or it will uphold the injunction NASCAR got and keep Mayfield officially sidelined until the “main event” case comes to the court next year.

Here’s the funny thing. Let’s say Mayfield’s lawyers win this round and the injunction is lifted. He has no team, no cars, no crew, and no (public) prospects to be scooped up by a team. It may not put him back on the track but it could send a powerful message through the halls of NASCAR’s Daytona office that they are in for a real fight.

The format of the hearing is interesting as SceneDaily.com reports at the link above. Each side will have 20 minutes to argue their case in front of a three-judge panel. Per the story, there will probably not be a decision rendered that day. It is during the off season and the judges would not be in any rush because there is not a NASCAR race for months.

Prepare for the Geragos media machine to start hitting on all cylinders in the weeks leading up to this hearing.
